Australian Permanent Residents and Resident Return Visa

Why does an Australian Permanent Resident need an RRV.

A Resident Return Visa is the Visa that allows a Permanent Resident to travel back into Australia.

When a new immigrant arrives in Australia they are given a FIVE year travel facility. This means they can travel in and out of Australia for the next FIVE years.

If they still need to travel overseas after that initial FIVE year period they need to obtain another Visa, a Resident Return Visa [RRV].

There are TWO options for this RRV

Subclass 157 Resident Return visa that allows you to travel overseas for a period of THREE MONTHS.

This RRV will normally be given to people who have spent less than two years in the past five years in Australia, but at least one day in the past five years in Australia.

Subclass 155 Resident Return visa that normally allows you to travel overseas for a period of FIVE YEARS, although in some cases just ONE year or less.

This RRV will normally be given to people who have spent at least two years of the past five years in Australia.

The RRV is not an automatic right.

For Example:

If you have been living outside Australia for more than three continuous months immediately before applying, you must also show that you were absent for a compelling and compassionate reason.

If you are granted a Subclass 155 Resident Return visa on the basis of your substantial ties of benefit to Australia, then your travel facility will be for a year from the date of the grant.

If you are granted a Subclass 155 Resident Return visa because you are a family member of a person who holds a Subclass 155, or who has also applied for Resident Return Visa and satisfies criteria for grant, then your travel facility will be for either a year or less than a year from date of grant.

The wording “compelling reasons” is seen many times in the rules and regulations for an RRV.

The best “compelling reason” is to show that you normally live in Australia.

What is a Resident Return Visa (RRV)?.

A Resident Return Visa (RRV) is a travel facility visa for Permanent Residents of Australia, and allows the holder to travel in and out of Australia as many times as they want until the travel validity expires.

A Permanent Resident visa only allows you to reside legally in Australia indefinitely. It does not by itself allow you to re-enter Australia, for that you need the extra RRV. However, the initial PR grant includes a 5 year RRV.

Do I need a Resident Return Visa (RRV)?.

You do not need an RRV if you are in Australia and not leaving. You can however, leave Australia without an RRV. You just can’t come back in without one.

What are the visa requirements for a Resident Return Visa (RRV)?.

You need to be the holder of an Australian Permanent Visa.

How Long does a Resident Return Visa (RRV) last?.

A Resident Return visa is normally issued with a validity period of between 3 months and 5 years.

If you have lived in Australia for 2 years (730 days) in the last 5 years as a permanent resident or former citizen or former permanent resident, you will normally be granted a 5 year travel validity on the RRV.

If you have not lived in Australia for 2 years in the last 5 years as a permanent resident or former citizen or former permanent resident, but can demonstrate substantial ties that are of benefit to Australia, then you might be given a maximum of 12 months travel validity on the RRV. However, this might only be 3 months, depending on your reasons and circumstances.

What is the Cost of a Resident Return Visa (RRV)?.

As at July 2022 the Resident Return Visa has a charge of $425 to apply online, and $505 for a paper application.

How Long does it take to get a Resident Return Visa (RRV)?.

Applications that meet the residence requirements will normally be processed within 5 working days from lodgement. Many are done in 2 days.

Those applications that do not meet the residence requirement normally take longer to process, and may take up to around 3 months from lodgement.
