AAT Partner Visa refusal decisions.
The AAT Migration & Refugee Division reviews appeals for such things as visa refusals, independently from the immigration department.
They often have a high workload and lengthy processing times.
As at 30 September 2021, there were:
1,915 subclass 820 refusal appeals in process, after 153 were finalised in the 3 months July to Sept 2021.
79 of these were set aside.
1,349 subclass 309 refusal appeals in process, after 132 were finalised in the 3 months July to Sept 2021.
80 of these were set aside.
What does “Set Aside” mean?
If we set aside a decision, it means we agree or partially agree the original decision was wrong.
We might replace it with a new decision or we might remit the decision which means we send the matter back to the department to make a new decision in accordance with our instructions or recommendations.
