Onshore Partner Visa 820 and Offshore Partner Visa 309.

There are two types of Partner visas for Australia, the Onshore applications (subclasses 820 and 801) and the Offshore applications (subclasses 309 and 100). They both allow the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.

Onshore Partner Visa 820:.

The Partner visas (subclasses 820 and 801) allow the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.

The temporary Partner visa (subclass 820) is granted first and lets you remain in Australia while the permanent Partner visa (subclass 801) is processed.

75 per cent of applications were processed in 22 months or less in July 2019. It was 18 months at August 2017.

Offshore Partner Visa 309:.

The Partner visas (subclasses 309 and 100) allow the overseas partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia.

The temporary Partner (Provisional) visa (subclass 309) is granted first and lets you come to Australia and stay while the permanent Partner (Migrant) visa (subclass 100) is processed.

75 per cent of applications were processed in 15 months or less in July 2019. It was 13 months at August 2017.

Subclass 309 – 100 application

Notes for the 820-801 and 309-100 applications:

You apply for both the permanent and temporary visas at the same time and pay only one fee, currently about $7,715. (July 2019)

You must have an eligible sponsor, this will be your partner.
You must be married, or in a de facto relationship, with: an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
The marriage must be valid under Australian law.
For a de facto relationship, you must be able to prove that you have been in that relationship for at least 12 months.
You must meet health and character requirements.
You must have not have any outstanding debts to the Australian government.
