Limitations on Sponsorship for Partner Visas.
Limitations apply if you:
Have previously sponsored a partner
or
Have been sponsored as a partner before
The most common limitation is briefly: No more than 2 partners visas being sponsored in a lifetime, and not more than one in a 5 year period.
A partner’s visa application may be refused if the Sponsor has been affected by previously successful partner applications. (A successful partner application means when a Visa [temporary or permanent] has been granted)
Limitations include if you:
- have previously sponsored or nominated 2 or more persons as a fiancǸ(e) or partner for migration to Australia (including sponsorships/nominations you may have withdrawn but your former fiancǸ(e) or partner obtained permanent residence on family violence grounds); or
- have sponsored another fiancǸ(e) or partner within the last 5 years; or
- were sponsored as a fiancǸ(e) or partner yourself within the last 5 years.
Approved sponsorships or nominations are those that resulted in the grant of a permission, an entry permit (granted prior to 1 September 1994) or a visa.
The purpose of the sponsorship limitation is to prevent abuse of the partner migration programme, but some circumstances exist to allow a waiver to this limitation. This can include the death of a partner, current longstanding relationship, children and any consequent hardship/detriment that you would suffer if the sponsorship was not approved.
The 5 year period starts from the date you lodged your first partner visa application.
